Summary of rights if orders are contemplated under the 3PR Act

  • Legal options should be used only if all other means of care and support are exhausted.
  • The person affected should be consulted and encouraged to use whatever capacity he or she has in making decisions.
  • The person affected is entitled to legal representation whether or not they have the means to pay for it.
  • The court should choose the least restrictive option with regard to cultural, religious and family values.
  • All orders should be reviewed regularly.
  • Property managers and welfare guardians must act in the person’s best interests. Their actions can be examined by the court.
